Overview
Redevelopment and reconstruction projects are representative urban improvement projects aimed at upgrading aging residential environments and restoring urban functions. They involve complex and intertwined interests over a long period — from association establishment, project implementation approval, and management and disposal plans through to sale and relocation/demolition.
In particular, due to the structure in which numerous stakeholders participate including associations, members, contractors, professional redevelopment project management companies, and financial institutions, various legal issues arise during project execution regarding the legality of decision-making, adjustment of ownership relationships, project costs and contribution amounts, contractor selection, and contract structure. Recently, issues related to construction cost increases, sales price regulations, project delays, and association internal conflicts have intensified, and the legal risks facing associations are growing.
